IMPORTANT NOTICE

www.raffles.co.za is strictly an intermediary platform acting as an agent to facilitate the marketing, sale of tickets, and bookings for events, shows, concerts, and online experiences on behalf of third-party Event Organizers, Promoters, and Venues. Raffles.co.za is not the Event Organizer, promoter, producer, venue owner, or provider of the actual events or services.

By accessing, browsing, or using www.raffles.co.za, or by purchasing tickets through our platform, you agree to be legally bound by these Terms and Conditions. These terms are structured in compliance with South African legislation, including the Consumer Protection Act No. 68 of 2008 (CPA), the Electronic Communications and Transactions Act No. 25 of 2002 (ECT Act), and the Protection of Personal Information Act No. 4 of 2013 (POPIA).

1. DEFINITIONS AND INTERPRETATION

  • “Buyer” / “User” / “You” means any individual or legal entity accessing the Website or purchasing tickets.

  • “Event” means any concert, show, theatrical performance, sporting event, festival, or online streaming event listed on the Website.

  • “Event Organizer” means the ultimate producer, promoter, venue, or entity responsible for organizing, hosting, and executing the Event.

  • “Platform” / “Website” / “We” / “Us” / “Our” refers to www.raffles.co.za, its owners, operators, and employees.

  • “Ticket” means a physical or electronic document, digital pass, or token granting access or viewing rights to an Event.

2. NATURE OF OUR SERVICE (INTERMEDIARY ONLY)

2.1. Platform Role: Raffles.co.za operates purely as an online ticketing and booking facilitator. We provide the technical software, marketplace, and payment gateway integration enabling Event Organizers to sell tickets to Users.

2.2. No Direct Liability for Events: Because we do not organize, manage, or control the Events:

  • We are not responsible for the fulfillment, quality, safety, staging, rescheduling, or cancellation of any Event.

  • Any claims, complaints, or legal liabilities regarding an Event (including venue conditions, sound/lighting quality, artist line-ups, security, or health and safety risks) must be directed exclusively to the Event Organizer.

    2.3. Contractual Relationship: When you purchase a ticket through www.raffles.co.za, the contract for the Event performance is strictly between you and the Event Organizer. Raffles.co.za acts merely as the limited billing and ticketing agent for that transaction.

3. REGISTRATION AND ACCOUNT SECURITY

3.1. You must be at least 18 years old (or possess legal parental/guardian consent) to register an account and purchase tickets on the Website.

3.2. You are responsible for maintaining the confidentiality of your account credentials and password. Raffles.co.za accepts no liability for any unauthorized use of your account resulting from your failure to safeguard your login details.

4. PRICING, PAYMENT, AND FEES

4.1. Ticket Prices: All ticket prices displayed on the Website are set by the Event Organizer (inclusive of South African VAT where applicable, unless explicitly stated otherwise).

4.2. Service Fees: Raffles.co.za may charge a non-refundable booking fee, transaction fee, or service charge per ticket or per transaction. This fee covers platform maintenance and payment processing costs and is explicitly detailed at checkout before payment confirmation.

4.3. Payment Methods: We accept secure online payments via approved South African payment gateways (credit/debit cards, EFT, instant EFT, mobile payments). Tickets will only be issued and delivered once payment has been successfully cleared and verified.

5. TICKET DELIVERY

5.1. Tickets are predominantly delivered digitally (via email, SMS, QR code, or downloadable link accessible via your www.raffles.co.za profile).

5.2. It is the Buyer’s sole responsibility to provide a valid email address and correct contact details. Raffles.co.za is not liable for non-delivery or delays caused by incorrect information provided by the User, spam filters, or network/telecommunication failures.

6. CANCELLATIONS, REFUNDS, AND RETURNS

6.1. Cancellations by Consumers (Section 17 of the CPA):

  • In accordance with South African consumer laws regarding advance bookings, you are entitled to cancel your ticket booking prior to the date of the Event.

  • However, because tickets represent time-sensitive leisure services, Event Organizers are legally entitled to impose a reasonable cancellation penalty depending on factors such as the nature of the event, when the cancellation notice is given, and potential re-saleability.

  • If you wish to cancel a booking, you must submit your request through our official support channels. Refund amounts (minus applicable booking fees and reasonable cancellation penalties determined by the Event Organizer) will be processed accordingly.

  • Exemption: No cancellation penalty may be charged if the cancellation is due to the death or hospitalization of the ticket holder, subject to providing acceptable written proof (such as a death or hospital certificate).

    6.2. Event Postponements, Cancellations, or Alterations by Organizers:

  • Raffles.co.za is not responsible if an Event is postponed, canceled, relocated, or materially altered by the Event Organizer.

  • If an Event is canceled outright by the Organizer, Raffles.co.za will facilitate refund requests from the Organizer. Please note: Raffles.co.za will only refund funds once they have been recovered/returned by the Event Organizer to us. Because our service fee covers platform processing that has already occurred, booking fees may be non-refundable unless otherwise decided by management.

  • If an Event is postponed, your ticket will typically remain valid for the rescheduled date. If you cannot attend the new date, you must request a refund within the timeline stipulated by the Event Organizer.

    6.3. No “Cooling-Off” Period for Leisure Services: Section 16 of the Consumer Protection Act does not apply to electronic bookings for entertainment or concert tickets scheduled for a specific date or time. Once purchased, standard return rights for change of mind do not apply outside of Section 17 rules noted above.

7. ONLINE EVENTS AND STREAMING ACCESS

7.1. For virtual/online events, access links and unique streaming codes are strictly personal to the buyer and may not be shared, broadcast publicly, or duplicated.

7.2. Users are solely responsible for ensuring they possess adequate, stable internet connectivity and compatible hardware/software to view online streams. Raffles.co.za and the Event Organizer are not liable for streaming failures resulting from the User’s local network setup, internet service provider, or device incompatibilities.

8. LIMITATION OF LIABILITY AND INDEMNITY

8.1. Website Use: The Website is provided on an “as is” and “as available” basis. Raffles.co.za makes no warranties, implied or express, regarding the uninterrupted availability, accuracy, or security of the platform.

8.2. Indemnification: By using www.raffles.co.za, you agree to indemnify, defend, and hold harmless Raffles.co.za, its directors, employees, and agents from and against any claims, liabilities, damages, losses, or expenses (including legal fees) arising out of:

  • Your breach of these Terms and Conditions;

  • Your attendance at any Event or behavior at a venue;

  • Any dispute between you and an Event Organizer.

    8.3. Maximum Liability: To the maximum extent permitted under South African law, Raffles.co.za’s total cumulative liability arising out of or related to any ticket purchase shall not exceed the face value of the ticket purchased plus the booking fee paid to us.

9. PRIVACY AND DATA PROTECTION (POPIA)

9.1. We collect, process, and store your personal information in strict accordance with the Protection of Personal Information Act (POPIA).

9.2. By purchasing tickets, you consent to Raffles.co.za sharing your relevant registration/contact details with the specific Event Organizer for the sole purpose of event administration, access control, emergency communication, and compliance with venue safety regulations. We will never sell your data to third-party marketers.

10. INTELLECTUAL PROPERTY

All content on www.raffles.co.za—including text, graphics, logos, button icons, software, and images—is the property of Raffles.co.za or its content suppliers and is protected under South African and international copyright and trademark laws. Unauthorized copying, reproduction, or scraping of our platform data is strictly prohibited.

11. GOVERNING LAW AND JURISDICTION

These Terms and Conditions shall be governed by, construed, and interpreted in accordance with the laws of the Republic of South Africa. Any disputes arising from these terms or ticket transactions through the platform shall be subject to the exclusive jurisdiction of the competent South African courts.
